Elibron is a Web site owned and operated by Adegi Media Corporation (Adamant Media).

Our goal is to offer the largest selection of important literary, scientific, artistic and musical works ever created, and make them available to our customers in a number of different formats.

By accessing any areas of Elibron Web site and using any of its services, user (“you” or “User”) agree to comply with and to be legally bound by the terms set forth herein:

I. ACCOUNT

You are responsible for maintaining the confidentiality of your user name and account password on Elibron Web site, and agree to accept responsibility for all activities that occur under your user name and password.

II. CHILDREN

Adegi Publishing – Adamant Media does not offer products to children. Users under 18 years of age may use Elibron Web site only with involvement of a parent or guardian.

III. PRIVACY

Adegi Publishing – Adamant Media respects privacy of Users. Please, read our Privacy Policy, which also governs your visit to Elibron Web site.

IV. RULES OF CONDUCT

You agree to use Elibron Web site for lawful purposes only. User is prohibited from posting or transmitting through Elibron Web site any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offence give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.

Adegi Publishing – Adamant Media reserves the right to prohibit any conduct and to remove any content that it deems in its sole discretion to violate any applicable law or to be harmful to Adamant Media and its affiliates and their employees, users of Elibron Web site, or any third party. Adegi Publishing – Adamant Media may terminate or suspend User’s access to all or part of Elibron Web site, without notice, for any such conduct.

 V. PRICE AND AVAILABILITY

Price and availability for each item is listed on that item’s page. When an item is offered in different formats, price and availability may vary for each format. After your order is received and verified, we will inform you by e-mail if any item in your order proves to be unavailable. The availability estimate on each item’s page does not include shipping time. Shipping time depends upon the shipping method chosen by User.

Adegi Publishing, Adamant Media, Elibron, Elibron.com, and Elibron Classics are all trademarks of Adegi Publishing Corporation / Adegi Graphics Corporation. All rights reserved. These and other trademarks, service marks and logos, owned by Adegi Publishing Corporation and its affiliates, may not be used without prior written consent of Adegi Publishing Corporation or its affiliates, as the case may be. All other company names and logos, trademarks and product names appearing on Elibron Web site are the property of their respective owners.

VII. CONTENT

All content included on Elibron Web site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and software (“Content”), is the property of Adegi Publishing – Adamant Media and its affiliates or content suppliers, as the case may be, and protected by United States and international copyright laws. Adegi Publishing  – Adamant Media owns a copyright in the selection, coordination, arrangement, and enhancement of such Content. User may not remove, delete, modify, create derivative works from, or in any way exploit any of the Content, in whole or in part. Except as permitted by the fair use privilege under the U.S. copyright laws (see, for example, 17 U.S.C. Section 107), User may not reproduce or distribute in any way Content protected by copyright, or other proprietary rights, without obtaining permission of the owner of the copyright or other proprietary right. Use of any software shall be governed by the software license agreement accompanying such software.

The unauthorized submission, removal, modification or distribution of copyrighted or other proprietary Content is illegal and could subject the User to criminal prosecution as well as personal liability for damages. User will be liable for any damage resulting from any infringement of copyrights or proprietary rights.

VIII. REVIEWS, COMMENTS, E-CARDS AND OTHER CONTENT

  User may post reviews and comments; send eCards; submit suggestions, ideas, comments, questions, or other information (“Submitted Content”), so long as the Submitted Content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, and does not consist of or contain software viruses, political statements, commercial solicitation, or any form of “spam.” User may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content.

Adegi Media –  Adamant Media reserves the right to remove such Submitted Content, but does not review all of the Submitted content.

User represents and warrants that he or she owns or otherwise controls all of the rights to the Submitted Content; that use of the Submitted Content will not cause injury to any person or entity; and that User will indemnify Adegi Media – Adamant Media or its affiliates, directors, officers and employees, for all claims resulting from Submitted Content.

By submitting reviews, comments or any other content to Adegi Media – Adamant Media for posting on Elibron Web site, User automatically grants to Adegi Media –  Adamant Media and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable right and license to use, reproduce, publish, translate, sub-license, copy and distribute such content in whole or in part worldwide and to incorporate it in other works in any form, media, or technology now known or hereinafter developed for the full term of any copyright that may exist in such content. Subject to this grant, User retains any and all rights that may exist in such content.

 IX. THIRD PARTY CONTENT

Adegi Publishing – Adamant Media distributes content supplied by third parties and Users (“Third Party Content”). Adegi Media – Adamant Media has no editorial control over Third Party Content. Any opinions, statements, offers or other information that constitutes part of Third Party Content, are those of the respective authors or distributors and not of Adamant Media or its affiliates or any of their directors, officers, employees or agents. Neither Adegi Media – Adamant Media nor its affiliates, nor any of their directors, officers, employees, or agents, nor any other Users of Elibron Web site, guarantees the accuracy, completeness, or usefulness of any Third Party Content, nor it marketability or fitness for any particular purpose.

It is the responsibility of User to evaluate the information, opinion, advice, or other content available through Elibron Web site. Adegi Media – Adamant Media and its affiliates, and their directors, officers and employees may not be liable for any loss, damage or harm caused by a User’s reliance on information obtained through Elibron Web site.

 X. DISCLAIMERS AND LIMITATION OF LIABILITY

User expressly agrees that the use of Elibron Web site is at User’s sole risk. Neither Adegi Publishing – Adamant Media, nor its affiliates, nor any of their directors, officers, employees, or agents, third party content providers, sponsors, licensors, or the like, warrant that Elibron Web site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of Elibron Web site, or as to the accuracy, reliability, or currency of any information, content, service or merchandise provided through Elibron Web site.

ELIBRON WEB SITE IS PROVIDED BY ADEGI PUBLISHING – ADAMANT MEDIA ON AN “AS IS” AND “AS AVAILABLE” BASIS. ADEGI MEDIA – ADAMANT MEDIA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW,  ADEGI MEDIA – ADAMANT MEDIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ADEGI PUBLISHING – ADAMANT MEDIA WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ELIBRON WEB SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

 XI. APPLICABLE LAW

You agree that the laws of the State of New York, without regard to principles of conflicts of laws, will govern this Elibron User Agreement and any dispute of any sort that might arise between you and Adamant Media or its affiliates. You hereby irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the courts of the State of New York and of the United States of America located in the Sate of New York for any litigation arising out of or relating to use of or purchase made through Elibron Web site, and agree not to commence any litigation relating thereto except in such courts.

 XII. OTHER PROVISIONS

Adegi Media –  Adamant Media reserves the right to make changes to Elibron Web site, to Elibron User Agreement and Privacy Policy at any time.

The provisions of this Elibron User Agreement are severable. If for any reason any provision of this Elibron User Agreement or Privacy Policy shall be held invalid or unenforceable in whole or in part in any jurisdiction, such provision shall, as to such jurisdiction, be ineffective to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction.

This Elibron User Agreement, including all documents referenced herein, represents the entire understanding between you and Adamant Media regarding your relationship with Adegi Publishing – Adamant Media and use of Elibron Web site and supersedes any prior statements or representations.

We do not authorize any commercial or public use of our books without our consent.

YOU AGREE TO BE BOUND BY THE TERMS OF USE BY VISITING AND USING THE ELIBRON WEB SITE.
